For this reason, in recent decades, international bodies, including the Committee on Economic, Social and Cultural Rights by approving Comment No. 15, have identified the access to water as a human right. But it is not easy to enjoy this right because of limited water resources, its non-availability, contaminated surface waters and the like, and it always creates problems for people, their families and even the community. Governments as the primary bound of this right have also sought to privatize water, because of the expense involved in collecting, storing and supplying water. But the question that arises is that, given that privatization leads to commercialization and economization of water, can it meet the characteristics and requirements of the right to water? Although there is no single global or regional model for this, the paper attempts to answer this question first by examining the nature and characteristics and requirements of the right to water from the perspective of international documents, especially the interpretative theory, and then characteristics and nature of privatization in this regard.}, keywords = {human rights,right to water,General Comment No. 15,Privatization}, title_fa = {تأثیر خصوصی‌سازی آب بر تکلیف دولت‌ها در مورد حق بر آب با تأکید بر نظریۀ تفسیری شمارۀ 15}, abstract_fa = {آب، نقش بنیادینی در زیست انسان دارد؛ به‌گونه‌ای ‌که نه‌تنها عملکرد درست بدن به آن وابسته است، بلکه حقی تأثیرگذار بر حق‌های دیگر انسان است. با تصویب نظریهٔ تفسیری شماره 15 از سوی کمیتۀ حقوق اقتصادی، اجتماعی، و فرهنگی، حقوق‌دانان، دسترسی به آب را، به‌ویژه در دهه‌های اخیر، به‌عنوان یک حق بشری شناسایی کرده‌اند. علم اقتصاد، به دلایلی ازجمله محدودیت منابع، دور‌از‌دسترس بودن، هزینه‌بر بودن خدمات جمع‌آوری، و سرانجام، ناتوانی دولت‌ها در تأمین، آب را به‌عنوان یک کالا درنظر گرفته و بحث خصوصی‌سازی آن را مطرح کرده‌ است. با توجه به اینکه خصوصی‌سازی به تجاری‌سازی و اقتصادی‌شدن آب می‌انجامد، آیا می‌تواند ویژگی‌ها و الزامات حق بر آب را اجرایی کند؟ به‌منظور پاسخ به این پرسش در این پژوهش سعی شده در قالب روش کیفی و بصورت کتابخانه‌ای، با مطالعۀ میان‌رشته‌ای حقوق و اقتصاد، ماهیت، ویژگی‌ها، و الزامات حق بر آب از منظر اسناد بین‌المللی بررسی و سپس، با توجه به این ویژگی‌ها و ماهیت خصوصی‌سازی، جنبهٔ اقتصادی این مسئله واکاوی شود.یافته‌های تحقیق نشان می­دهد که خصوصی‌سازی آب، بدون توجه به بعد حقوق بشری آب، با تجاری تلقی کردن آن حق بر آب انسان‌ها و به تبع آن سایر حق‌های انسان را تحت تاثیر قرار می‌دهد و ضرورت دارد تا خصوصی­سازی آب تا بدانجا باشد که باعث نادیده انگاشتن حق‌های بشری نشود.}, keywords_fa = {حقوق بشر,حق بر آب,نظریۀ تفسیری شماره 15,خصوصی‌سازی}, url = {http://www.isih.ir/article_376.html}, eprint = {http://www.isih.ir/article_376_fb50f1dfb88fcbe6ab5431a0b27264d4.pdf} }
